NY Sports Betting Regulations
NY sports betting actually dates all the way back to 2013 when voters in the state passed a referendum to expand gambling in the state. Sportsbooks were included in that referendum, but the state has to wait for the federal ban on sports betting to be lifted, which didn’t happen until 2018.
The New York State Gaming Commission approved sports wagering rules and regulations in January 2019 even though legislation was not signed. There were some attempts during that year to allow for online sports betting as well, but those bills died out quickly.
Senator Joseph Addabbo has long been the state’s leading proponent of legalization, and introduced several bills to regulate online sports betting. He had trouble getting the bills out of the state Senate until 2021 when there was finally a breakthrough due to the state’s revenues significantly decreasing due to COVID. In spring 2021, the state budget that included language to legalize sports betting was passed by the legislature and signed into law by Governor Cuomo.
Governor Andrew Cuomo was originally an opponent of NY online sports betting, claiming that a constitutional amendment was needed to add that form of betting. Cuomo changed his stance and became a supporter of legal online sportsbooks in the state.
NY Online Betting Gets Passed
After the state budget was signed into law in spring 2021, state regulators got to work developing rules and guidelines for regulated online sports wagering, including setting a tax rate at an unheard of 51 percent. At the end of 2021, after accepting applications from sportsbooks wanting to do business in the state, nine sportsbook operators were selected to offer online sports betting through mobile betting apps.
This list included a consortium of FanDuel, DraftKings, BetMGM, and Bally Bet. Another group of operators is made up of Caesars, Wynn Interactive, Resorts, PointsBet, and Rush Street Interactive.
The third group of operators that did not get access to the licenses consisted of Fanatics, Penn National’s Barstool Sportsbook, and celebrity music mogul Jay-Z.
